【禁闻】分析:周永康泄密罪若做实 或死刑


日前,中共前政法委书记,并被正式逮捕,官方通报了周永康 的6项罪名, 其中〝泄露党和国家机密〞罪,成为国际舆论关注的焦点。专家分析,这项指控在中共执政史上罕见,一旦做实,周永康可能会被判处死刑。


12月6号凌晨,中共官方公布对中共前政治局常委周永康案的处理决定,周永康被开除党籍,并移送司法机关处理。最高检察院宣布逮捕周永康,对其涉嫌犯罪立案侦查。


中共公布了周永康6大罪名,包括违反政治、组织及保密纪律;巨额受贿;泄露党和国家机密;通奸及权色、钱色交易等。 6宗罪中的〝泄密〞罪,成为外界关注的焦点。


中国 资深法学专家赵远明表示,〝泄密〞罪的指控,在中共执政史上比较罕见,作为中共前政法委书记,周永康掌握着中共最高核心机密,这项指控一旦做实,周永康可能会被判处死刑。


中国资深法学专家赵远明:〝像周永康这种级别的人,他已经等于是位于权力中心了。他要是泄密可能就是关于到国家很高级,很机密的事情,甚至于在泄露秘密的时候,可能在政治上,经济上有所交易,所以现在给他单独列出一种犯罪行为。〞


英国《》引述《星期日泰晤士报》的报导说,有西方外交界消息人士透露,周永康经常与外国情报机关首脑见面,不过这样的会晤从来不公开宣布。这些会谈的话题包括中国在反恐战争中的合作,交换在阿富汗的流亡维吾尔激进人士情报,北韩核计划和伊朗原子能研究等。


报导还说,周永康被控泄露党和国家机密,是西方外交界人士热衷知道的内容。中共已经暗示周永康可能被判死刑。


赵远明:〝在习江争斗当中,他一直是不停的搅和,他把中共的那些内幕 的争斗,通过媒体,或者通过跟国外的外交人员泄露,因为他也想从国外争取到一些舆论支持,甚至于一些政府或个人的支持。〞


时政 评论员古春秋认为,周永康泄密的关键部分,是他把最高层 讨论的如何处理前重庆市委书记薄熙来的决定,透露给了薄熙来。


时政评论员古春秋:〝中共的体制就是一个对信息的封锁,它们做任何事情都是要封锁信息,那周永康可能主要还是说,透露了当时胡锦涛,还有习近平,关于对薄熙来作决定的一些信息给薄熙来,其实按照我们来理解,就是中共内斗一种表现,说明它内部的那种撕裂。〞


赵远明:〝我估计关键还是在党内把这些重要的机密,泄露给他们的同僚或者是,或者是江派的媒体舆论方面,这样的话以便在社会当中,在和争斗当中,争取主动。〞


香港《东方日报》质问,作为主管全中国反谍防奸的最高领导人,周永康自己居然也泄密,中又怎能保守秘密?


而经济学家何清涟,在《》发表题为〝周永康泄露了哪些‘国家机密’?〞的文章 说,〝泄密〞很可能是指,自重庆事件后,涉及中共高层 家族财富的故事。


1月21号,由国际记者联盟 (ICIJ)推出的《中国离岸金融报告解密》,公布了上百位中共高层家属的资料,独缺中共大贪家族——家族,家族和周永康家族等。


何清涟分析,独缺江、曾、周三家的资料,可能是:两间离岸中介公司因某种短处被中共国家安全部的特工拿捏,不得不在威胁下交出资料,于是周永康等有办法做点手脚,删除江泽民、曾庆红与周永康等家族成员的相关资讯,再将资料外泄出去。


何清涟说,这份资料涉及人数共有37,000多名,高层家族成员上百位,充分暴露了中共盗贼型政权的本质。当然中共更会认定,这份报告对所谓的〝党与国家〞形象伤害极大。


赵远明指出,周案涉及的政变和活摘罪行还被掩盖着。目前对周案泄密罪的指控,也可能是为不公审周永康找藉口,因为之前时,当局精心安排的三宗轻罪,被薄熙来全部否认。

Death Sentence for Zhou Yongkang if Leak Crime Confirmed


Recently, Zhou Yongkang, former secretary of the Political

and Legal Commission was formally arrested after expulsion

from the Party.


Among the 6 official crimes, the crime of leaking became

the focus of international media attention.

It’s analyzed this allegation is rare in the history of Chinese

Communist Party (CCP) rule.

Zhou Yongkang will be sentenced to death once it’s confirmed.


December 6 early morning, the CCP officially announced the

expulsion of Zhou Yongkang from the Party and was transfered

to judicial organs.


Supreme People's Procuratorate announced the arrest of Zhou

Yongkang and filed to investigate him.


The CCP announced six crimes, including breach of political, organizational and confidential discipline; huge bribes;

disclosure of party and state secrets; adultery and

transactions among power, money and sex.

Among those, the leak crime became the outside focus.


China senior legal expert Zhao Yuanming said the leak

allegation is relatively rare in CCP history.

As former secretary of the Political and Legal Commission,

Zhou Yongkang held the highest core secrets and could be

sentenced to death once the allegation is confirmed.


Zhao Yuanming: "Zhou Yongkang’s level means he has been

located in the center of power.

It’s possible for him to leak very high level state secrets and

trade in politics and the economy.

So they list this crime separately for him."


British BBC quoted a Sunday Times report that Western

diplomatic sources said Zhou Yongkang often met with

foreign intelligence heads in secret.


Topics included China's cooperation in the anti-terrorism war;

the exchange of exiled Uyghur activists’ intelligence in

Afghanistan;

North Korea's nuclear program and Iran's atomic energy research.


The report also said, Western diplomats are keen to know the

Party and State secrets leaked by Zhou Yongkang.

The Party has hinted that Zhou may face the death penalty.


Zhao Yuanming: "He kept stirring in the battle between Jiang

and Xi to release the struggle inside through media or foreign

diplomats.


Because he wanted to get support of public opinion, and

even governmental or individual support."


Political commentator Gu Chunqiu believes the key point is

he told former Chongqing Party Secretary Bo Xilai about how

the highest level will deal with him.


Gu Chunqiu: the CCP system is to block information.

They will block all information about everything.

Probably, Zhou Yongkang also revealed decisive information

about Bo Xilai from Hu Jintao and Xi Jinping.

It’s part of the inner struggle within the Communist Party,

indicating its internal tearing apart."


Zhao Yuanming: "I guess the key is he released these important

secrets to his colleagues, Jiang faction or Jiang's faction media

within the Party.


So they can gain the initiative in the battle with Xi and Li."


Hong Kong Oriental Daily questioned, how can Zhongnanhai

keep secrets if the highest leader to anti-spy in China, himself

leaked the secrets?


Economist, He Qinglian, published an article in Voice of America,

entitled "What state secrets did Zhou Yongkang release?"

The article says, most likely, the secrets refer to CCP high level

family wealth after the Chongqing event.


January 21, The International Consortium of Investigative

Journalists (ICIJ) published the "Chinese elite's offshore holdings".

It announced hundreds of CCP high-level families' information

except the biggest corrupt families - Jiang Zemin family, Zeng

Qinghong family and Zhou Yongkang family.


He Qinglian said the reason for the missing three families might

be because two offshore intermediary companies were threatened

to give the information because some shortcomings were handled

by China state security.

Then Zhou Yongkang released after deletion of Jiang Zemin, Zeng

Qinghong and other related families' information.


He Qinglian said that the documents include more than 37,000

people, hundreds of high level family members.

It fully exposed the robber nature of the CCP regime.


Of course, the CCP definitely believes the report greatly hurts

the so-called party and state image.


Zhao Yuanming noted the coup and live organ harvesting crime

involved in Zhou's case were also concealed.

Currently, the crime of leaking might be an excuse for a

private trial of Zhou Yongkang because before, the three

misdemeanors carefully arranged by the authorities,

were denied by Bo Xilai.
